General Terms and Conditions of Sale for Products Sold on noeud-papillon-en-bois.fr

Article 1 - Purpose

These terms govern the sales by the company 3d-mountain, 5 rue des Myosotis, 63610 Besse, of decorative items and various other products, personalized or not.

Article 2 - Prices

Our product prices are indicated in euros, inclusive of all taxes (VAT and other applicable taxes on the order date), unless otherwise stated and excluding handling and shipping fees.

If you order products for delivery outside mainland France, you are the importer of the products concerned. Customs duties or other local taxes, import duties, or state taxes may be payable. These charges are not the responsibility of SASU 3d-mountain. They will be your responsibility, including any declarations and payments required by the relevant authorities and bodies in your country. We advise you to check with your local authorities about these aspects.

All orders, regardless of their origin, must be paid in euros.

SASU 3d-mountain reserves the right to modify its prices at any time, but the product will be invoiced based on the current price at the time of order validation, subject to availability.

Products remain the property of 3d-mountain until full payment of the price.

Note: Once you physically take possession of the ordered products, the risk of loss or damage to the products is transferred to you.

3d-mountain reserves the right not to record a payment or to refuse to confirm an order for any reason, particularly in the event of supply issues or difficulties related to the received order.

Article 4 - Order Validation

Any order placed on the website noeud-papillon-en-bois.fr implies acceptance of these Terms and Conditions. Any order confirmation constitutes your full acceptance of these terms, without exception or reservation.

All the data provided and the recorded confirmation will serve as proof of the transaction.

You acknowledge that you are fully aware of this.

The order confirmation will serve as a signature and acceptance of the operations carried out.

A summary of your order information and these Terms and Conditions will be sent to you in PDF format via the order confirmation email.

Article 5 - Payment

Validating your order obliges you to pay the indicated price.

Payments are made by credit card through a secure system.

Article 6 - Withdrawal

In accordance with Article L.121-21 of the Consumer Code, you have a 14-day withdrawal period from the receipt of your products to exercise your right of withdrawal without having to justify any reasons or pay any penalties.

Returns must be made in their original and complete state (packaging, accessories, instructions). In this context, you are liable. Any damage to the product during this period may invalidate the right of withdrawal.

Return shipping costs are your responsibility.

If you exercise the right of withdrawal, 3d-mountain will refund the amounts paid within 14 days of your request and through the same payment method used during the order.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

According to Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

• Services fully executed before the end of the withdrawal period and whose execution began after the consumer’s express prior consent and waiver of the right of withdrawal.
• Goods or services whose price depends on financial market fluctuations beyond the control of the professional and likely to occur during the withdrawal period.
• Goods made to the consumer's specifications or clearly personalized.
• Goods that may deteriorate or expire quickly.
• Goods that have been unsealed by the consumer after delivery and cannot be returned for hygiene or health protection reasons.
• Goods that, after delivery and by their nature, are inseparably mixed with other items.
• Alcoholic beverages whose delivery is deferred beyond thirty days and whose agreed value at contract conclusion depends on market fluctuations beyond the professional's control.
• Audio or video recordings or computer software unsealed by the consumer after delivery.
• Newspapers, periodicals, or magazines, except subscription contracts for these publications.
• Transactions concluded during a public auction.
• Digital content not provided on a physical medium, where execution has begun after the consumer’s express prior consent and waiver of the right of withdrawal.

Article 7 - Availability

Our products are offered as long as they are visible on the site noeud-papillon-en-bois.fr and within the limits of available stock. For non-stocked products, our offers are valid subject to availability from our suppliers.
If a product becomes unavailable after you place an order, we will notify you by email. Your order will be automatically canceled, and no charge will be made.

Article 8 - Delivery

Products are delivered to the delivery address specified during the order process, within the timeframe indicated on the order validation page.

In the event of a shipping delay, an email will be sent to inform you of any impact on the delivery time initially indicated.

In accordance with legal provisions, in case of delayed delivery, you have the option to cancel the order under the conditions and terms defined in Article L 138-2 of the Consumer Code. If you receive the product in the meantime, we will refund it and cover shipping costs in accordance with Article L 138-3 of the Consumer Code.

If delivery is made by a carrier, 3d-mountain cannot be held responsible for delivery delays due solely to the customer’s unavailability after several appointment proposals.

Article 9 - Warranty

All our products benefit from the legal guarantee of conformity and the warranty against hidden defects, as provided by Articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it may be returned, exchanged, or refunded.

All complaints, requests for exchange, or refund must be made by email within 30 days of delivery.

Products must be returned in the condition in which you received them, with all elements (accessories, packaging, instructions). Shipping costs will be reimbursed based on the invoiced rate, and return costs will be refunded upon presentation of receipts.

These provisions do not prevent you from benefiting from the right of withdrawal as provided for in Article 6.

Article 10 - Liability

The products offered comply with current French legislation. 3d-mountain’s liability cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities about the import or use possibilities of the products or services you plan to order.

Furthermore, 3d-mountain cannot be held responsible for damages resulting from misuse of the purchased product.

Finally, 3d-mountain cannot be held liable for any inconvenience or damage inherent to the use of the Internet, including service interruptions, external intrusion, or the presence of computer viruses.

Article 11 - Applicable Law in Case of Disputes

The language of this contract is French. These terms of sale are subject to French law. In case of disputes, only French courts will have jurisdiction.

Article 12 - Intellectual Property

All elements of the website noeud-papillon-en-bois.fr are and remain the intellectual and exclusive property of 3d-mountain. No one is authorized to reproduce, exploit, redistribute, or use any part of the site, whether software, visual, or audio, even partially. Any simple or hypertext link is strictly prohibited without the express written consent of 3d-mountain.

Article 13 - Personal Data

3d-mountain reserves the right to collect personal information and data about you. They are necessary for the management of your order and for improving the services and information we provide.

They may also be transmitted to companies that contribute to these relationships, such as those responsible for executing services and orders for their management, execution, processing, and payment.

This information and data are also stored for security purposes to comply with legal and regulatory obligations.

In accordance with the law of January 6, 1978, you have the right to access, rectify, and oppose personal information and data concerning you directly on the website.

Article 14 - Archiving Proof

3d-mountain will archive purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with Article 1348 of the Civil Code.

The computerized records of 3d-mountain will be considered by all parties involved as proof of communications, orders, payments, and transactions between the parties.
